Robert J. Dupont has developed a dynamic and comprehensive law practice representing clients before the Immigration Service, the Executive Office of Immigration Review (Removal Courts) , the Federal District Court and 9th Circuit Court of Appeals. He is a graduate of Yale University and USC Law School and a recipient of a Public Interest Law Foundation Grant from USC. Prior to joining Wilner & O'Reilly, Mr. DuPont served as a law clerk for the American Civil Liberties Union (ACLU) and as a research attorney/law clerk for the Honorable Fumiko Wasserman and Honorable Charles McCoy of the Los Angeles Superior Courts. His representation of immigrants began as early as 1992 when he provided assistance to "Marielito" Cubans as in a USC Law School clinical program.
Robert Dupont remains a forceful advocate for immigrant rights in the federal courts and has developed a specialty in compelling action on delayed cases (Writs of Mandamus) and challenging erroneous decisions made by USCIS or the Department of State. Following his victory in the case of Akhtar v. Burzynski before the Ninth Circuit Court of Appeals, the Immigration Service was forced to revise its regulations and national policy concerning V-Visa Non-Immigrant Visas. This has allowed thousands of children admitted to the U.S. in V-2 status to remain in the U.S. with work authorization until they are eligible to apply for legal permanent residency.
Mr. DuPont, himself a husband and father of three children places great stress in his practice on the importance of family unity and re-unification. He takes particular satisfaction with regard to compelling action on family separation cases where a spouse and children are stranded in their home country. Mr. DuPont has been a speaker for the Immigration Law Weekly Seminar Series on the subject of V-visas as well as compelling action on pending applications before the Federal District Court.
Mr. DuPont is a member of the State Bar of California and is a founder and past chairman of the Beverly Hills Bar Association Immigration Law Committee. He is admitted to the California Superior Court; the U.S. District Court, Central and Northern Districts of California; the Southern District of Texas; the District Court of Nebraska; and the U.S. Court of Appeals, Ninth Circuit.
Mr. Duponts' published cases include Reeves v. Hanlon, 33 Cal.4th 1140 (California Supreme Court 2004) and Akhtar v. Burzynski, 384 F.3d 1193 (California 9th Circuit Court of Appeals 2004).
