USCIS recently posted an “Alert” on its Public Charge website regarding the Coronavirus Disease 2019 outbreak (COVID-19) that encourages everyone with symptoms (fever, cough, shortness of breath) to seek necessary medical treatment or preventive services. This also includes noncitizens experiencing those symptoms. USCIS stated that such “treatment or preventive services will not negatively affect any alien as part of a future Public Charge analysis.” (For more information on the Public Charge Rule, please go to “The public charge rule is back (for now)” by Joshua J. Despain) During this time of uncertainty, many noncitizens are legitimately concerned about their health,...

The Coronavirus (COVID-19) outbreak has brought about a new normal for many of us. Countries have implemented travel restrictions, airlines have cancelled flights, certain borders have been closed and many individuals are under quarantine orders. Due to these evolving changes, individuals who entered the U.S. on a B1/B2 visa or with an Electronic System for Travel Authorization (ESTA) may find themselves unable to leave the United States for COVID-19 related reasons. However, remaining in the U.S. beyond your period of admission can have serious immigration implications. As such, individuals who entered the U.S. on a B1/B2 visa or with ESTA...

ABOUT AUTHOR(S) CHIEN-YU (MICHAEL) WANG – Managing Attorney – Sacramento Chien-Yu (Michael) Wang is the Managing Attorney at Wilner & O’Reilly’s Sacramento office.

Given the orders adopted by various governmental bodies across the nation during this global pandemic, individuals have been ordered to shelter in place and avoid non-essential group gatherings. In some areas, businesses and organizations not engaged in providing essential products and/or services were also ordered to close. Thus, employers have been scrambling to modify schedules, implement full-time equivalent (FTE), and assign work for employees to work from home (WFH) in order to ensure the safety and welfare of their employees, clients, and the general public. Unfortunately, some have even had to lay-off or furlough employees. Companies employing those in nonimmigrant...

The spread of Coronavirus Disease 2019 (COVID-19) has resulted in an unprecedented disruption of routine and life in the United States. In this time of uncertainty, we want to provide some guidance and reassurance regarding how the present crisis affects U.S. immigration: Will USCIS consider granting any leniency to those unable to meet certain filing deadlines because of COVID-19? Most likely. While USCIS has closed its doors to all in-person services at its field offices, asylum offices and Application Support Centers (ASCs), effective until at least April 7, they are still working on processing applications. Federal regulations and USCIS policy...

Recently, I have had many consultations with frustrated applicants seeking remedies for their delayed applications. We have seen naturalizations taking over 3 years without any substantial updates, adjustment of status applications that has taken over 4 years still under review to affirmative asylum applications pending for over 7 years with no interview date in sight. We understand that USCIS is still catching up from backlogged cases caused by the COVID-19 pandemic. However, people are becoming increasingly frustrated with the process. When unreasonable government delays occur, the only true effective remedy is to file a writ of mandamus with the federal...

Special Immigrant Juvenile Status, also referred to as “SIJS” is a remedy that allows undocumented children under the age of 21 years old to obtain lawful status in the United States. This unique process generally requires three steps. First, one must seek an order from a state juvenile court judge. Once the order is obtained, the child’s newly appointed guardian may petition the immigration service on behalf of the child. Finally, upon approval of the special immigrant visa application, the child will be able to apply for adjustment of status with USCIS or at immigration court if the undocumented child...

What are the requirements of Cancellation of Removal for Certain Nonpermanent Residents?
