Legal update: October 19, 2026. This article provides general information, not advice about an individual case. Rules, agency practices, and court decisions can change.
Filing a work permit renewal does not necessarily let you keep working after the current authorization expires. The answer depends on your eligibility category, when USCIS received the renewal, and whether another legal basis or a specific extension applies. A USCIS receipt notice does not, by itself, establish continued employment authorization. For qualifying renewal applications filed before October 30, 2025, however, a receipt notice together with other required documentation may establish an automatic extension.
What Did the October 2026 Final Rule Change?
On October 14, 2026, DHS published Removal of Automatic Extensions for Certain Employment Authorization Documents, 91 FR 65306. The rule took effect that day and finalized the October 30, 2025 interim rule without changing its regulatory provisions.
The key renewal-filing cutoff remains October 30, 2025—not October 14, 2026. For affected renewals filed on or after October 30, 2025, the filing itself generally does not automatically extend the expiring EAD or employment authorization. Earlier qualifying filings and extensions provided separately by law or an applicable Federal Register notice require a different analysis.
Which Situation Applies to You?
| Your situation | What to check before continuing work |
|---|---|
| A renewal properly filed before October 30, 2025 | A qualifying, timely renewal may retain an automatic extension of up to 540 days under the earlier provisions, measured from the expiration date of the prior EAD, subject to the applicable eligibility requirements and any earlier termination of the extension. Category, receipt notice, and other requirements still matter; not every filing qualifies. |
| A renewal filed on or after October 30, 2025 | For affected categories, there is generally no automatic extension simply because the renewal is pending. Confirm whether you have a separate valid authorization or applicable exception. |
| TPS-related employment documents | Check the exact country, category, card expiration date, re-registration requirements, and applicable Federal Register notice. There is no blanket extension for everyone with TPS. TPS-related employment authorization may be subject to separate statutory limits and country-specific Federal Register notices. Individuals should verify the applicable designation, documentation category, and extension dates rather than relying on a general statement that all TPS work permits remain valid. |
| Employment authorization incident to status | An expiring EAD may not mean that underlying work authorization ends at the same time. The status, its validity, and acceptable evidence must be reviewed separately. |
| A pending I-485 or asylum application | A pending adjustment-of-status application or asylum application does not, by itself, authorize employment. Applicants who rely on employment authorization granted through these applications generally must have a valid EAD, a qualifying automatic extension, or another independent basis for employment authorization. |
The Filing Date and the Receipt Notice Matter
The final rule explains that a qualifying pre-cutoff application must have been properly received by USCIS before October 30, 2025. Mailing a package before the cutoff is not enough if USCIS received it on or after that date. An eligible earlier renewal must also meet the applicable timing, category, and other requirements.
An automatic extension is a limited period, not a guarantee that authorization lasts until USCIS decides the renewal. Its end date and any event that ends it sooner must be checked. A work-authorization extension also does not automatically extend travel permission on a combination EAD/advance-parole card.
EAD Expiration and Immigration Status Are Different Questions
An EAD is evidence of employment authorization. Some people obtain work authorization through an approved application in a particular category; others are authorized to work incident to a qualifying immigration status. For that reason, neither “my card expired” nor “my immigration case is pending” provides a complete answer by itself.
For example, the final rule discusses an L-2 spouse whose qualifying status continues beyond the EAD expiration date. That person may remain employment authorized through status, but an expired EAD is not itself valid evidence for employment verification. The correct status record and other acceptable documentation must be evaluated.
What Employees and Employers Should Do Now
- Identify the category and dates. Review the EAD, USCIS receipt notice, any status document, and any relevant approval or extension notice.
- Check the renewal filing window early. Use the current Form I-765 instructions and category-specific requirements; avoid assuming that the same timing applies to every category.
- Confirm the actual authorization period. Ask whether a qualifying earlier extension, TPS notice, or separate work-authorized status applies.
- Plan for a possible gap. Timely filing is important but does not guarantee USCIS will approve the renewal before expiration.
- Review Form I-9 evidence. Employers should follow current USCIS guidance and applicable nondiscrimination rules rather than assuming every expired card has the same result.
If continued authorization cannot be established, obtain advice before working after it expires. Do not assume that a pending renewal, an expedite request, or an employer’s willingness to keep you on payroll creates authorization.
If an employee’s current work authorization expires before USCIS approves the renewal, and no automatic extension or other valid authorization applies, the employee generally cannot continue working during that gap. Filing the renewal early may reduce the risk of interruption, but does not guarantee uninterrupted employment authorization.

Frequently Asked Questions
Does filing my renewal before my card expires automatically let me keep working?
Not necessarily. For affected renewal applications filed on or after October 30, 2025, timely filing alone generally does not provide an automatic extension. Your category and any separate legal basis must be reviewed.
Did the October 2026 rule cancel every earlier automatic extension?
No. The final rule preserves the earlier provisions for qualifying renewals properly filed before October 30, 2025, and does not eliminate extensions provided separately by law or applicable Federal Register notices.
Does this rule mean everyone must stop working when an EAD expires?
No. Some people have employment authorization incident to status or another valid basis. Whether authorization continues and which documents prove it are separate questions that require review.
